Hereafter referred to as "Flove".

Buyer is:

Person who is stated as the buyer at the order.

Referred to herein as "you", "buyer" or "customer".

The buyer and seller are collectively referred to as the "parties".

  • General

Purchases of goods or services from flove.no are governed by the provisions of these Terms and conditions. The buyer must be over 18 years of age to shop at flove.no.

  • Ordering and agreement

The terms and conditions, together with the customer's order, information provided in the order solution and any special agreement terms, constitute the overall contractual basis for the purchase. In the event of any conflict between the information, what has been specifically agreed between the parties will prevail, as long as it does not contravene mandatory legislation. The agreement will also be supplemented by relevant legal provisions that regulate the purchase of goods between businesses and consumers.

Your order is binding when your order is registered on Flove's server. Flove is at the same time bound by your order if this does not deviate from what is offered at flove.no.

Upon receiving the order, Flove will confirm the order by automatically issuing the order confirmation. Carefully read the order confirmation when you receive it and check that it complies with your order.

Discrepancies between the customer's order and the order confirmation are considered a new offer from Flove, which you can accept or decline. You still have the right to make your original booking if it is in accordance with what is offered at flove.no. Exceptions may occur, for example, in case of obvious pricing errors – see the section below on prices.

However, the agreement is not binding if writing or keying errors have occurred in the offer from Flove in the ordering solution in the online store or in the buyer's order, and the other party realized or should have realised that such a mistake existed. In case of such writing or printing errors of significant size in ads, online store etc. Flove can unilaterally modify, delete or reject orders.

  • Price terms

All prices are quoted including VAT in Norway and excluding VAT outside Norway. Shipping is also available. Any customs regulations in the country of order are in addition to imports. Here, different rules apply in different countries.

Shipping Rates:

– Shipping is additional. In Norway, the shipping price is 38kr, in Europe 70kr and outside Europe 90kr. Shipping with tracking costs 269 kr.

Flove reserves the right to change prices.

  • Payment

The buyer can choose between the  Paypal, Klarna or Vipps payment solutions. When paying with a debit or credit card, Stripe can reserve the purchase price on the card when booking.

  • Delivery and risk of the item

Delivery is occurred when the customer, or its representative, has received the goods or service in its possession.

If the delivery of the product is delayed, Flove will provide the customer with information as soon as Flove has knowledge of it, along with information about and, optionally, when delivery will occur or whether the product is sold out.

If the delivery time is not stated in the booking solution, Flove shall deliver the goods to the buyer without undue delay and 30 days after order from the customer. The goods shall be delivered to the buyer unless otherwise expressly agreed by the parties.

Delivery of the products happens in the manner, in that place and at or within the time agreed. For national shipping within Norway, Flove is responsible for the products until they are taken over by you, ie when you have received the products in your possession.

For international delivery outside Norway Post's area of operation, the risk of loss of goods falls on the buyer when delivered to the carrier in the case of shipping without tracking, ie without insurance.

For all orders outside Norway customs and import costs may occur. We recommend that the customer check with customs in their country for more details. Flove cannot be held responsible for additional costs in connection with customs duties and other import costs. The customer is entirely responsible for this.

  • Return and right of withdrawal

The buyer must give the seller notice of the use of the right of withdrawal within 14 days from the deadline begins to run. On the deadline, all calendar days are included. If the deadline ends on a Saturday, holiday or holiday day the deadline is extended to the nearest business day.

The cancellation deadline is considered complied with if notification is sent before the expiry of the deadline. The buyer has the burden of proving that the right of withdrawal has been exercised, and the notification should therefore be made in writing (right of withdrawal form, e-mail or letter).

The cancellation deadline begins to run:

  • When purchasing individual items, the cancellation period will run from the day after the item (s) is received.

The withdrawal period is extended to 12 months after the expiry of the original deadline if the seller does not state before the conclusion of the agreement that there is a right of withdrawal and a standardized withdrawal form. The same applies in the event of lack of information about terms, deadlines and procedures for using the right of withdrawal. If the trader provides the information during these 12 months, the cancellation period still expires 14 days after the day the buyer received the information.

When using the right of withdrawal, the item must be returned to the seller without undue delay and no later than 14 days from notification of use of the right of withdrawal. The buyer covers the direct costs of returning the item, unless otherwise agreed or the seller has failed to disclose that the buyer shall cover the return costs. The seller may not determine a fee for buyer's use of the right of withdrawal.

The seller is obliged to repay the purchase price of the purchaser without undue delay, and at least 14 days from the seller received notification of the buyer's decision to use the right of withdrawal. The seller has the right to withhold the payment until he has received the goods from the buyer, or until the buyer has submitted documentation for the goods to be sent back.

NB: The right of withdrawal for intimate products is exempt from the Right of Withdrawal Act §22 if the seal is broken after delivery.

 

  • Refund

Payment by credit card

If the purchase is completed by credit card, the money will be refunded to the same card that was made at the purchase.

Payment with Vipps

If your purchase is completed with Vipps, your funds will be paid back to the same account

 

  • Delay and non-delivery – the purchaser's rights and deadline for filing claims

If Flove does not deliver the goods or delivers them late in accordance with the agreement between the parties, and this is not due to the buyer or circumstances on the buyer's side, the buyer may, according to the rules in Chapter 5 of the Consumer Purchase Act, withhold / or claim compensation from Flove. In the event of a claim for default rights, the notification should, for evidentiary reasons, be in writing (for example e-mail).

  • Fulfillment

The buyer can maintain the purchase and demand fulfillment from Flove. However, the buyer may not demand fulfillment if there is an obstacle that Flove cannot overcome, or if fulfillment will entail such a great inconvenience or cost for Flove that it is in significant disproportion to the buyer's interest in Flove fulfilling. Should the difficulties disappear within a reasonable time, the buyer can still demand fulfillment. The buyer loses his right to demand fulfillment if he or she waits unreasonably long to advance the claim.

  • Elevation

If Flove does not deliver the goods at the time of delivery, the buyer shall encourage Flove to deliver within a reasonable additional deadline for fulfillment. If Flove does not deliver within the additional deadline, the buyer can cancel the purchase. However, the buyer can cancel the purchase immediately if Flove refuses to deliver the item. The same applies if delivery at the agreed time was decisive for the conclusion of the agreement, or if the buyer has informed Flove that the time of delivery is decisive. If the goods are delivered after the additional deadline set by the consumer or after the time of delivery that was decisive for the conclusion of the agreement, the claim for cancellation must be made within a reasonable time after the buyer became aware of the delivery.

  • Replacement

The buyer may claim compensation for suffered losses as a result of the delay. However, this does not apply if Flove ensures that the delay is due to hindrance outside of Flove's control which could not reasonably be taken into account at the time of appointment, avoided, or overcome the consequences of.

  • Defect with the item – buyer's rights and claims term

If there is a defect with the item, the buyer must within a reasonable time after it was discovered or should have been discovered, notify Flove that he or she will invoke the defect. The buyer has always complained in time if it happens within 1 month. from the defect was discovered or should have been discovered. If the item has a defect and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the rules in the Consumer Purchase Act, Chapter 6, withhold the purchase price, choose between correction and re-delivery, demand price reduction, demand termination of the agreement and Flove. Complaints to Flove must be made in writing.

  • Correction or Redelivery

The buyer can choose between requiring the defect corrected or delivery of similar things. Flove can still oppose the buyer's claim if the implementation of the claim is impossible or give Flove unreasonable cost. Rectification or redelivery shall be made within a reasonable time. Flove does not initially have the right to make more than two remedy attempts for the same shortage.

  • Price reduction

Buyer may require a suitable price reduction if the item is not corrected or redelivered. This means that the ratio of the discounted and agreed price corresponds to the relationship between the goods value in deficient and contractual condition. If there are special reasons for it, the price reduction can instead be set equal to the significance of the defect for the buyer.

  • Elevation

If the item is not corrected or redelivered, the buyer may also raise the purchase when the defect is not insignificant.

  • Floves Rights at buyer's defaults

 

If the buyer does not pay or fulfill the other obligations under the agreement or the law, and this is not due to Flove or circumstances on Flove's part, Flove may according to the rules in the Consumer Purchase Act chapter 9, depending on the circumstances, withhold the item, demand fulfillment of the agreement, demand termination of the agreement and claim compensation from the buyer. Flove will also, depending on the circumstances, be able to claim interest in the event of late payment, collection fee and a reasonable fee for uncollected goods.

  • Fulfillment

Flove can maintain the purchase and demand that the buyer pay the purchase price. If the item is not delivered, Flove loses its right if Flove waits unreasonably long to advance the claim.

  • Elevation

Flove may terminate the agreement if there is a material default or other material default on the part of the buyer. However, Flove cannot withdraw if the full purchase price has been paid. If Flove sets a reasonable additional deadline for fulfillment and the buyer does not pay within this deadline, Flove can cancel the purchase.

Interest on late payment/collection fee

If the buyer does not pay the purchase price in accordance with the agreement, Flove may demand interest on the purchase price in accordance with the Late Payment Interest Act. In the event of non-payment, the claim can, after prior notice, be sent for debt collection. The buyer can then be held liable for fees under the Debt Collection Act. If the buyer fails to collect paid items, Flove may charge the buyer a fee. The fee shall at most cover Flove's actual expenses for delivering the goods to the buyer.

  • Rights

The website flove.no and all content available there belong to Flove or our partners. The information is protected i.a. through intellectual property and marketing laws. Trademarks, company names, product names, images, graphics, designs, layouts and product information, or other content, may not be reused without Flove's prior written approval.

  • Personal data

By accepting these terms and conditions, you agree that Flove may process the personal information obtained in connection with the purchase and its implementation, within the framework described in this section.

Flove may process the following personal data about you:

  • Name and Address
  • E-mail
  • Phone number
  • Purchase information, including information about items you purchase, time and cost.
  • Payment information processed by Stripe and Vipps
  • Information about any correspondence between them and Flove in connection with the purchase

Flove is responsible for processing personal data obtained in connection with the purchase. Flove will process your personal information to manage and complete your order, to deliver the goods to you.

Unless you have agreed to something else, Flove may, in accordance with the Personal Data Act, only process the personal data that is necessary for Flove to be able to fulfill its obligations under the agreement. Your personal information will only be disclosed to others if it is necessary for Flove to implement the agreement, or in statutory cases. To the extent necessary to complete payment, Stripe and Vipps will process your payment information on behalf of Flove..

  • Information provided in the online bank

 

At the same time as Flove strives to give customers as accurate a description of products as possible on flove.no, there may be typos / printing errors, minimal color variations from the image to the actual product due to a number of factors, such as the color setting and contrasts set up for the screen or which browser is used. Flove cannot be held responsible for color differences in accordance with information provided on flove.no, through marketing or in any other way.

Flove reserves the right to cancel your order if the product is sold out. The customer will receive information about this together with information about what Flove can offer instead. The customer will have the opportunity to accept a new offer or cancel the order.

Flove reserves the right to discontinue use of flove.no at any time, for example during maintenance procedures.

  • Disputes and choice of law

Complaints must be addressed to Flove within a reasonable time, cf. points 9 and 10.

Disputes arising out of or arising in connection with the purchase shall be resolved amicably by the parties. If the parties do not reach an agreement, the buyer can bring the matter before the Consumer Council for mediation. In other respects, disputes belong to the ordinary Norwegian courts, with the Oslo District Court as venue.

(1) These conditions, together with the ordering solution, shall ensure that the customer receives the information to which the customer is entitled, including information that there is a right of withdrawal. The terms do not have to inform about the rules for the situation where the byer has not provided such information.
